On Friday, November 28, 2025, Justice Peter Rosinski will consider a Notice of Motion to approve a proposed settlement in the following class action lawsuit:
SH-447198 - Richard Robert Martell and Michael Harry Gerald Perrier Vs. The Attorney General of Nova Scotia, representing Her Majesty the Queen in right of the Province of Nova Scotia and Atlantic Provinces Special Education Authority
The case, first filed in January 2016 and certified as a class proceeding in January 2019, alleges the Defendants were negligent in operating, supervising and managing the School for the Deaf in Halifax and the Interprovincial School for the Education of the Deaf in Amherst. The Plaintiffs bring this action on behalf of themselves and all former students who attended and/or resided at one or both of the schools and suffered physical, sexual and/or emotional abuse.

This proceeding will be livestreamed from Courtroom 504 at the Halifax Law Courts on the Courts of Nova Scotia website to ensure it is accessible to members of the class. The livestream will include ASL interpretation.
