PLEASE NOTE:
Form 5.07 under the sub-heading "You may participate" (on page 41) currently reads; "You may file with the court a notice of contest, and any affidavit for the motion for directions, no less than five days after this notice is delivered to you ....."

The "five days" should read "15 days" to conform with amended Rule 5.08(1).

Form 5.07 will be officially amended in October to reflect this change.

The Civil Procedure Rules govern proceedings in Nova Scotia's Court of Appeal and Supreme Court. The Civil Procedure Rules are made and amended by the Judges of the Supreme and Appeal Courts under the authority of the Judicature Act R.S.N.S. 1989, c. 240, s. 46
The Judges of the two Courts made new Civil Procedure Rules on June 6, 2008. Part 13 - Family Proceedings - was completed in April of 2010.

These new Rules are in effect as of January 1st, 2009 and June 30th, 2010 (Part 13 - Family Proceedings) except as provided in Part 19 - Transition, Rule 92.

Order In Council - determining the manner of publication of the Civil Procedure Rules.

Certificate of Publication - causing the revision of the Civil Procedure Rules to continue to be published online and certifying that copies of the revisions have been delivered.

Royal Gazette (November 19, 2008) - published Certificate of Publication.
