Bankrupts returning to Bankruptcy Court on their own behalf to
have previous Court Orders varied must follow the steps listed below
and complete the required documentation:
1. The bankrupt must obtain a date for a Court Hearing
by attending the Court Administration Office at the Law Courts, 1815
Upper Water Street, Halifax, N.S., or calling 1(902) 424-6908 if you
do not live in the area. While at the Court Administration Office
the bankrupt must obtain from his or her bankruptcy file a copy of
the List of Creditors;
2. Once a Court Hearing Date is received you must prepare a Notice
of Hearing; (Click to view a sample) The

word processor by pressing your Ctrl + V key. You can then enter the
required information and print out the document.]
3. An Affidavit must be completed stating the reasons why you are
making an application to the court. Your affidavit must be signed
by you and sworn by a Commissioner of Oaths; (Click

V key. You can then enter the required information and print out the
document.]
4. Once your Notice of Hearing and Affidavit are completed they must
be filed at the Court Administration Office with a court fee. The
court fee for a Summary Administration is $10.00 and for an Ordinary
Administration the fee is $50.00;
5. Copies of your Notice of Hearing and your Affidavit must be mailed
to the following at least two weeks prior to the Court Hearing date:
A. All of your creditors (you will find their addresses
from the List of Creditors you obtained from your bankruptcy file)
B. Your Trustee in Bankruptcy
C. The Superintendent of Bankruptcy

6. Be sure to attend your Court Hearing on the
date and time of your Notice of Hearing, and bring proof that you
mailed the notice as described in 5. above.
