ABANDONMENT OF CRIMINAL APPEAL BEFORE THE NOVA SCOTIA COURT OF APPEAL

 

1.        Read the attached Notice of Abandonment Form 91.23 carefully and retype the Notice of Abandonment with your own information.

 

2.        Civil Procedure Rule 91 applies to all criminal appeals before the Nova Scotia Court of Appeal - review the rule on the courts website at: www.courts.ns.ca

 

3.        You must file an original and two (2) copies of your Notice of Abandonment with the Registrar of the Court if you do not wish to continue with your appeal before the Court of Appeal.

 

4.        You must sign the Notice of Abandonment personally and your signature must be witnessed. The witness must either be your lawyer or an officer of the institution in which you are imprisoned. If your signature is NOT witnessed you must provide an affidavit verifying it is indeed your signature on the Notice of Abandonment.

 

5.        You must provide a copy of the Notice of Abandonment to each Respondent on the appeal.

 

6.        You must also send a copy of the Notice of Abandonment to the judge from whose judgment the appeal is brought.
