The Supreme Court Family Division deals with all family law matters arising inside the Regional Municipalities of Halifax and Cape Breton.
Family law matters (except for divorce and division of property) arising in areas outside HRM and CBRM are dealt with by the Nova Scotia Family Court. The Supreme Court outside HRM and CBRM deals with family law matters involving divorce and division of property.
The Supreme Court Family Division was established in Nova Scotia to deal with all family law matters in the Halifax Regional Municipality and in Cape Breton Regional Municipality. This court and its services give people the opportunity to resolve family matters in a more cooperative and less adversial manner. It is hoped the additional locations will be added in the future.
Judges of the Family Division are usually assigned to a particular geographic area. However, each judge has jurisdiction to hold proceedings throughout the Province.
While the Civil Procedure Rules apply, generally, to proceedings in the Family Division, Part 13 - Family Proceedings is of particular relevance.
