SUPREME COURT CRIMINAL MATTERS

Application to Review (to vary either an undertaking or recognizance)

Circumstances may change that require an application to a Supreme Court justice, by an accused or by a Crown prosecutor, to review an undertaking or a recognizance granted by the Provincial Court with the request that the original conditions be changed.

There are different forms to be used to reflect whether the applicant is an accused or a Crown prosecutor. Please ensure you use the correct form.

When making such an application, you must, include with your documents, a copy of the original Undertaking or Recognizance you seek to have review along with a copy of the Information with endorsements.

You must state clearly the changes you wish to have the Crownside justice grant on the review of the Undertaking or Recognizance.

Your first court appearance will be at Crownside to set a date for the hearing of the review application.

Your documents must be filed no later than 10:00 a.m. on the Wednesday preceding the Thursday you intend to appear in Crownside to have your application heard and you must serve a copy of the documents you file with the court on either the Provincial of the Federal Crown. The address for service is noted on the Review Notice of Hearing form.

You will require at least three (3) copies of your Notice of Application with attachments. We will keep the original copy of the documents and return the other two(2) copies to you. You must serve the other parties named in the application with your filed documents.
